the stakes: a global framework, a balance between
freedom and privacy
Should we promote the growth of a global regulatory framework
(
applicable in France, and more widely, in Europe), particularly
concerning intellectual property and privacy rights? In collaborative
approaches (open innovation, crowd-sourcing…), where a competitive
advantage does not last for long, the major issues are intellectual
property, including the legitimacy of copyright, and privacy protection
through the strengthening of surveillance regulation.
Digital technology has brought about a conflict between regulation and
freedom in business. This conflict becomes problematic for businesses
as soon as they need to arbitrate between privacy concerns and the
development of commercial activities based on new business models,
or on the transformation of management methods (mobility, Cloud
Computing).
The challenges : digital identity, normalisation
Regulating
:
addressing the issue of digital identity on a national level
or through European bodies, and not leaving it up to GAFA.
Reassuring
:
promoting a European trust system (Cloud Computing,
Big Data). To respect user privacy, businesses must be proactive and
not become too intrusive in clients’ lives.
Guaranteeing
that the business complies with the regulatory texts
of their sectors, and with texts framing digital activities (to avoid
contradiction, notably concerning Cloud Computing).
Anticipating
:
businessesmust beattentive to technologies susceptible
to being normalised, identify the pertinent normalisation trends to
follow and create links between R&D and normalisation.
